Simply put, the EIS of public procurement is a nationwide site that contains a huge amount of information related to the organization and conduct of procurement for state and municipal needs. The law allows the subjects of the Russian Federation and municipalities to create regional and municipal information systems, but all of them must be integrated with the EIS. 1. What is an EIS?

As already mentioned in the water part of the article, UIS stands for unified information system.

According to paragraph 9 of Article 3 of the Federal Law of 05.04.2013 No. 44-FZ “On the contract system in the field of procurement of goods, works, services to meet state and municipal needs” (hereinafter referred to as 44-FZ)unified information system in the field of procurement - a set of information contained in databases, information technologies and technical means that ensure the formation, processing, storage of such information, as well as its provision using the official website of the unified information system on the Internet (hereinafter referred to as the official website).

2. Official website of the EIS

From January 1, 2016 to replace the official website Russian Federation A unified information system in the field of procurement came to the Internet to post information about placing orders for the supply of goods, performance of work, and provision of services.

The main goal of creating such an information system was to increase the transparency of public procurement so that all processes within the contract system from the stage of procurement planning to the completion of contracts become more public.

All information contained in the UIS is public (with the exception of information containing state secrets) and is provided free of charge. In addition, such information must be complete and reliable.

Responsible state body for the development of the concept and definition functional requirements to the UIS is the Ministry of Economic Development of Russia (MED). And the Federal Treasury is responsible for the development and operation of the system.

At the initial stage of creating a unified information system in the field of procurement, two options were considered:

  1. creation of a system based on the existing public procurement website;
  2. building a system from scratch.

In view of the fact that the second option turned out to be more resource-intensive, it was decided to create a system based on the existing site. For this reason, the EIS address remained the same - www.zakupki.gov.ru

According to part 7 of article 4 of 44-FZ, subjects of the Russian Federation and municipalities have the right to create regional and municipal information systems in the field of procurement, integrated with a single information system. However, if there are discrepancies in the information posted on the website of the subject and the UIS, the information posted in the unified information system has priority. Those. For suppliers, this suggests that to search for information on ongoing public procurement, both within the framework of 44-FZ and 223-FZ, the functionality of the UIS will be more than enough.

3. What information is contained in the unified information system?

According to part 3 of article 4 of 44-FZ, the UIS should contain:

3) information on the implementation of procurement plans and schedules (since January 1, 2017);

4) information on the conditions, prohibitions and restrictions on the admission of goods originating from a foreign state or a group of foreign states, works, services, respectively, performed, provided by foreign persons, a list of foreign states, groups of foreign states with which the Russian Federation has concluded international treaties on mutual application of national treatment in procurement, as well as the conditions for the application of such national treatment;

5) information on procurement and execution of contracts;

6) register of contracts concluded by customers;

7) ;

8) a library of standard contracts, standard conditions of contracts;

9) register of bank guarantees;

10) register of complaints, scheduled and unscheduled inspections, their results and orders issued;

11) a list of international financial organizations established in accordance with international agreements to which the Russian Federation is a party, as well as international financial organizations with which the Russian Federation has concluded international agreements;

12) the results of procurement monitoring, audit in the field of procurement, as well as control in the field of procurement;

13) customer reports provided for by 44-FZ;

14) catalogs of goods, works, services to meet state and municipal needs;

15) normative legal acts;

16) information on the prices of goods, works, services that are being procured in the commodity markets to meet state and municipal needs, as well as on requests for prices of goods, works, services placed by customers;

17) other information and documents, the placement of which in a single information system is provided for by 44-FZ, Federal Law of July 18, 2011 No. 223-FZ "On the procurement of goods, works, services by certain types legal entities”(hereinafter 223-FZ) and other regulatory legal acts adopted in accordance with them.

4. What does the EIS provide?

EIS provides:

  • formation and placement of information through information interaction of the UIS with other information systems without the need additional entrance V Personal Area EIS;
  • control of information and documents to be placed in the UIS, in cooperation with other information systems;
  • transition to the use of OKPD2 and OKVED2;
  • implementation functionality for the Federal Corporation for the Development of Small and Medium Enterprises;

5. Benefits of the ENI

The main and fundamental difference between the unified information system and the previously existing public procurement website is the maximum automation of the procurement process from posting a notice to summarizing and executing the contract. All data entered into the system is processed automatically, and the required reporting is generated based on this data. The entire document management system is on the site in the public domain.

The EIS is tightly linked with other regional information systems and electronic platforms, which together creates a single information space.

Also, an undoubted advantage is the fact that all procurement plans, as well as schedules, will be posted in the EIS (from January 1, 2017) only in a structured (machine-readable) form. This innovation will significantly expand the ability to search for procurement information using simple search queries, as, for example, in search engine Yandex or Google.

I note that on the old public procurement website, these documents were posted in scanned form, which did not allow suppliers, and other interested parties to fully search for information. Now, this innovation will allow suppliers to predict in advance the demand among customers for their goods, works or services and draw up a long-term plan for participating in purchases.

In addition to functional changes, the developers also performed technological work to improve the performance and fault tolerance of the UIS, improved search functions, a search parameter constructor appeared, optimized user interface its open part. The system has acquired a more modern and beautiful interface. However, the full set of features will become available to users from January 1, 2017.

6. Legislative regulation of the work of the EIS

The requirements for the creation and supervision of the UIS are described in Federal Law No. 44-FZ as well as in Government Decrees dated September 30, 2014 No. 996 “On the distribution of powers between the Ministry of Economic Development and the Federal Treasury when creating the UIS” and dated January 23, 2015 No. 36 "On the procedure and timing of the commissioning of the UIS".

Public procurement - official site

The MER (Ministry of Economic Development of Russia) and the Federal Treasury are responsible agencies for the concept and development of the Unified Information System resource. EIS based on zakupki.gov.ru functioning successfully.

44-FZ controls the functioning of the UIS, and also obliges to fulfill a number of requirements. This portal should contact and interact with other information systems and provide the following points:

Initially, Decree of the Government of the Russian Federation of January 23, 2015 No. 36 prescribed to implement the possibility of submitting bids by bidders in electronic form through the Unified Information System until January 1, 2017. However, by Decree of the Government of the Russian Federation of December 31, 2016 No. 1588, the deadline for completing this task was postponed to a date no later than January 1, 2018.

To do this, all procurement participants must register with the EIS.

The Federal Treasury, financial authorities, constituent entities of the Russian Federation and municipalities, bodies of state extra-budgetary funds, when placing procurement plans and procurement schedules, control the following data in planning documents:

  1. compliance of information on the amount of financial support included in the procurement plans with information on the amount of financial support for procurement, approved and communicated to the Customer;
  2. compliance with the information on identification codes of purchases and on the amount of financial security for the implementation of these purchases, contained:

a) in the schedules, information contained in the procurement plans;

b) in notices of procurement, in procurement documentation, information contained in schedules;

c) in the protocols for determining suppliers (contractors, performers), information contained in the procurement documentation;

d) in the terms of draft contracts sent to procurement participants with whom contracts are concluded, the information contained in the protocols for determining suppliers (contractors, performers);

e) in the register of contracts concluded by the Customers, the terms of the contracts.

It turns out that when the Customer places planning documents on the EIS public procurement website, they are checked and approved by the relevant financial authorities. Verification is carried out no more than 3 working days from the date of sending the procurement plan and the procurement schedule for placement in the Unified Information System.

Based on the results of the check, using the internal functionality of the EIS, a mark is made on the compliance or non-compliance of the information provided in the planning documents.

If inconsistencies are identified, then information about the identified inconsistencies is sent to the Customer using the Unified Procurement Information System (and in some cases on paper), and until the violations are eliminated, planning documents will not be posted on the official public procurement website.

It is also worth noting that if the Customer does not have a connection through the EIS personal account with the financial control authority, from January 1, 2017, the Customer cannot place the procurement plan and the procurement schedule in the Unified Information System.

According to parts 37 and 38 of Art. 112 44-FZ,

customers, authorized bodies and institutions at the level of the constituent entity of the Russian Federation and the municipal level located on the territory of the Republic of Crimea and the city of Sevastopol publish in the EIS schedules for placing orders according to the rules that were in effect before the introduction of 44-FZ. That. it turns out that in 2017 the Customers of Crimea and Sevastopol do not have a two-stage planning system and instead of procurement plans and procurement schedules, a schedule for placing orders for 2017 is formed and posted.

Changes in the EIS since 2018

In January 2018, information about the system update was published on the website of the Unified Information System and explanations were given on the specifics of working with the new functionality.

1. Implementation of control under part 5 of article 99 of Law No. 44-FZ

For customers at the federal level, the condition for placing documents in the EIS was renewed, depending on the results of the verification.

The customer must send documents from his personal account for verification to the Control Authority. With a positive result of the verification, the documentation is automatically placed in the EIS.

In case of a negative result, the customer must correct the violations and re-send the documents for verification. However, even if a protocol of non-compliance is received, the customer can manually publish data in the EIS, with a note that the control object received a negative result when checked by the Control Authority.

For customers at the regional and municipal level, the previous scheme of work remains until the end of 2018.

Functionality has also been added to control federal state unitary enterprises that carry out purchases through subsidies for the purchase of real estate and capital investments in federal property.

Registration in the EIS

From January 1, 2019, suppliers will need to do three things to participate in e-procedures:

  1. Register in the EIS;
  2. Submit information to unified register procurement participants (ERUZ);
  3. Be accredited at the ETP (no later than the working day following the day spent on the first two points).

From January 1, only persons who have placed information in the ERUZ will be able to open special accounts. An unpleasant situation for the participant may arise, therefore the EIS recommends not to delay registration and accreditation.

Those suppliers who are accredited on the ETP must register with the EIS within a year - until December 31, 2019. It is only necessary to update the information and documents on the ETP by January 1, 2019, provided for in Article 62 of Law No. 44-FZ.
If the participant has nothing - neither accreditation nor a special account - then you first need to register with the EIS, and then the information will be transferred to the sites for accreditation.

3. Displaying a new section "Register of sole suppliers"

The federal executive authority and the executive authority of the constituent entities of the Russian Federation that have concluded special contracts providing for counter investment obligations of the supplier-investor have access to the functionality of generating and sending information intended for inclusion in the Register of Sole Suppliers.

To ensure the operation of this functionality, a personal account of the executive authority has been implemented in the EIS, which provides information and documents for inclusion in the register.

4. Changes in the form of the annual report on purchases from the SMP (for customers under 223-FZ)

In this regard, now in the EIS it is possible to reflect the following information in the form of an annual report on the purchase of GWS from SMEs:

    information on long-term contracts;

    information about small businesses.

Also, from January 1, 2018, changes to the requirements for the mandatory volume of purchases come into force, in which ONLY small and medium-sized businesses can become participants. With 10% he increases up to 15% from the total annual volume of purchases.

To simplify the work, the UIS has a function automatic check procurement plans and annual procurement reports for compliance with the established purchase amount, intended only for SMEs.

The 15% volume check will be applied from the 2018 annual reports, while the 2017 reports will be checked at 10%

5. Formation in the EIS of information on the accepted budgetary obligations

In cases where the purchase is carried out in order to implement informatization measures, then in the information on the budget obligation sent for registration, it is now possible to additionally indicate the code and name of informatization measures by selecting it from the Informatization Measures directory, and not manually .

Consequences of changing the EIS

The introduction of all these changes has a beneficial effect on the search for interesting tenders, which can be found not only by the purchase number, but also to view ongoing tenders, for example, by a certain Customer.

Ideally, the official website of the Unified Procurement Information System should combine all the data from each trading platform on federal level. Part 7 of Article 4 of 44-FZ does not prohibit the creation of other information portals of the regional and municipal scale, which will be integrated with the EIS. The main thing is that the data published on these portals should match and not contradict each other. Otherwise, priority is given to the Unified Information System and the information posted in it is considered reliable.
