According to paragraph six of clause 29 of the Rules for the provision of telephone services, tariffs for telephone services, including the tariff used to pay for an incomplete tariff unit, are established, including changed, by the telecom operator independently, unless a different procedure is established by the legislation of the Russian Federation (hereinafter - Rules).

Administrative plaintiff M. was notified of the time and place of the court hearing, did not appear in court, and asked to consider the case in his absence.
The representative of the administrative plaintiff B. supported the stated demands in court.
The Government of the Russian Federation instructed the Ministry of Communications and Mass Media of the Russian Federation to represent its interests in the Supreme Court of the Russian Federation (instruction dated April 12, 2016 N AD-P10-2087).
Representatives of the Government of the Russian Federation Z., Kh. objected to the satisfaction of the stated demands and explained to the court that the contested regulatory legal act was issued within the powers of the Government of the Russian Federation, complies with the current legislation and does not violate the rights of the administrative plaintiff.
Having listened to the report of the judge-rapporteur N.S. Romanenkov, the explanations of B., representing the interests of the administrative plaintiff M., representatives of the Government of the Russian Federation Z., Kh., having examined the case materials, having heard the conclusion of the prosecutor of the General Prosecutor's Office of the Russian Federation L.F. Masalova, who believed that the administrative claim cannot be satisfied, and the judicial debate, the Supreme Court of the Russian Federation does not find grounds to satisfy the stated requirements.
Regulating legal basis activities in the field of communications on the territory of the Russian Federation, Federal Law of July 7, 2003 N 126-FZ “On Communications” in Article 44 defines the powers of the Government of the Russian Federation to approve the rules for the provision of communication services.
In pursuance of the Federal Law "On Communications" and the Law of the Russian Federation "On the Protection of Consumer Rights", the Government of the Russian Federation, by Decree No. 1342 of December 9, 2014, approved the Rules for the provision of telephone services.
The regulatory legal act was published on the official Internet portal of legal information http://www.pravo.gov.ru, December 15, 2014, in the Collection of Legislation of the Russian Federation on December 22, 2014, No. 51.
The rules govern the relationship between the subscriber and (or) user of telephone services and the telecom operator in the provision of local, intrazonal, long-distance and international telephone services in the public communications network, as well as in the provision of mobile radio communications services, mobile radiotelephone communications services and mobile satellite services radio communications in a public communications network.
In accordance with Articles 44 and 54 of the Federal Law "On Communications" on the territory of the Russian Federation, communication services are provided by communication operators to users of communication services on the basis of an agreement for the provision of communication services, concluded in accordance with civil legislation and the rules for the provision of communication services, approved by the Government of the Russian Federation; the procedure and form of payment for communication services are determined by the agreement on the provision of communication services, unless otherwise established by the legislation of the Russian Federation; Payment for local telephone connections is made at the choice of the citizen subscriber using a subscriber or time-based payment system.
An agreement on the provision of communication services concluded with citizens, according to Article 45 of the Federal Law “On Communications”, is a public contract. The terms of such an agreement must comply with the rules for the provision of communication services. The contract specifies its essential terms: subscriber number ( subscriber numbers) or unique identification code (unique identification codes); telephone services provided; payment system for telephone services; procedure, terms and form of payments (clause 23 of the Rules).
A tariff plan is a set of price conditions under which a telecom operator offers to use one or more telephone services. Tariffs (tariff plans) are established for one or more telephone services; when forming them, a subscriber payment system, a time-based payment system, or a combined payment system can be used.
The rules oblige the telecom operator to notify subscribers about this at least 10 days before changing the current tariffs for telephone services through the telecom operator’s website on the Internet information and telecommunications network. Mobile subscribers for whom the variable tariff, additionally short text messages are sent with information about changes in current tariffs for mobile communication services, unless otherwise provided by the Rules (clause 24).
The administrative plaintiff's arguments about the contradiction of the contested provisions of the Rules with the norms of the Civil Code of the Russian Federation are unfounded.
The Civil Code of the Russian Federation does not allow unilateral refusal to fulfill an obligation and unilateral change of its conditions (clause 1 of Article 310).
In accordance with the Civil Code of the Russian Federation, termination of a contract is possible by agreement of the parties, while the agreement to amend or terminate the contract is made in the same form as the contract, and if the parties have not reached such an agreement, then at the request of one of the parties the contract may be terminated by the court (clause 1 of article 450, clause 1 of article 452).
The contested provisions of the regulatory legal act correspond to paragraph 1 of Article 28 of the Federal Law "On Communications", according to which tariffs for communication services are established by the telecom operator independently, unless otherwise provided by this Federal law and the legislation of the Russian Federation on natural monopolies, and do not provide the telecom operator with the right to unilaterally change the payment system for telephone services agreed with the subscriber.
By virtue of clause 2 of part 2 of Article 215 of the CAS of the Russian Federation, based on the results of consideration of an administrative case on challenging a normative legal act, the court makes a decision to refuse to satisfy the stated requirements if the normative legal act challenged in whole or in part is recognized as corresponding to another normative legal act that has greater legal force .
Based on the above and guided by Articles 175, 176, 180, 215 of the CAS RF, the Supreme Court of the Russian Federation

The administrative claim of M. to recognize partially invalid the sixth paragraph of clause 29 of the Rules for the provision of telephone services, approved by Decree of the Government of the Russian Federation of December 9, 2014 N 1342, shall be refused.
The decision can be appealed to the Appeals Board of the Supreme Court of the Russian Federation within a month after the court makes its decision in final form.

The Beeline operator has launched a line of new tariffs with a block of prepaid services. In the updated versions of the “Everything” tariffs, the cost of calls abroad has increased. For example, if earlier outgoing calls to Beeline phones in the CIS countries and Georgia cost 12 rubles per minute, to other numbers - 24 rubles, now all these calls cost 30 rubles per minute. This means that the cost has increased by 150 and 25% respectively.

Calls to Europe, as well as the USA and Canada used to cost 35 rubles per minute, to other countries in North and Central America - 40 rubles. With the new tariffs, all these calls have risen in price to 50 rubles (an increase of 43 and 25%, respectively). Calls to other countries are more expensive - 80 rubles per minute, which is 45% higher than before (before the tariff update the price was 55 rubles).
